FWIW I think that this new argument, PTAB should not review on procedural grounds, IMHO lot more persuasive and changes my probability to 50-50.
In considering if the review should be instituted, the PTAB generally gives the benefit of the argument to challenger, allowing for the real debate to take place in the review itself. For that reason if the initial filing by the challenger is well drafted (which does not make it true, but at first glace appear to be persuasive) the review gets granted. So I had thought about a 70% chance of review earlier.
In CORT's filing they make a decent case on procedural grounds, which I think helps them and makes the review a toss-up
