if vhc lost on the second case cafc heard, cafc could have written an opinion easily. stock went down, thinking vhc was toast. apparently, not unanimous, slam dunk. also, vhc attorney did not give best answer at orals. but, quickly wrote a letter with clarification, correcting the record. again, if cafc chose to ignore the letter, it could have decided quickly against vhc.
