Update from DelawareNew filings this week in Del. Chancery Court in the case of MT vs MG. First MG filed a Motion to Continue [Postpone] Trial, claiming that NY discovery has been delayed due to Covid and there isn't enough time to line up expert witnesses. MT filed an opposition to any delay stating this has already dragged on long enough, that neither expert witnesses nor additional discovery are necessary for the issues in Delaware. The issues in Delaware are different than the NY Fed.Dist.Ct. case. In Del. MG is being sued by MT for breach of fiduciary duty and conversion and NY is more complex and includes MG counter-suing NAVB for breach of the August Agreement. It is important to keep in mind that this Del action will not resolve the NY counter-claims. In fact the Del Vice Chancellor assigned to this case has already said during a summary judgment hearing that
The Del court may rule soon on MG's motions and MT's counter motions which should determine whether a 3 day trial will proceed as currently scheduled on Dec. 1-3, 2020.
