IMO. Very interesting the last document of Pacer, everything that is happening in the lawsuit against Google in the last hours:
1º- It is clear that Netlist and Google are negotiating, that is why the postponement or truce of these very important motions until November 8, to try to reach an agreement before.
2º- Google claims that Netlist is asking for an exorbitant amount.
3º- Google prefers to go to a jury trial before the judge decides. Netlist's shareholders do not believe anything. Google does not want either one or the other. It is clear that the conversations are being very hard.
4º- At OMI. This Pacer document is addressed to the judge, to Netlist and to Google's own investors (investment funds and small shareholders). He is telling them that there is a small company that has sued them and they are going to have to pay a large amount for having infringed their IP after 12 years of infringement. They have no choice. He is preparing the stock market for the consequences of this lawsuit.
Finally, I just have one doubt. If Google is going to pay an amount that they consider exorbitant to Netlist, what will they opt for in the end, to buy Netlist or just pay that amount?
At this moment it is not clear to me!!!!
