$NLST I’d like to reiterate the significance of Judge Gilstrap not assigning a Magistrate on this case to handle discovery(including disputes) & claim construction, like he did in our other 2 cases. I believe he recognizes the 912 patent litigation history and the importance of the matter, and wants to be the one to resolve it with a rightful and just conclusion.There has to be a reason since he is the busiest patent judge and usually does refer these aspects to a magistrate—mostly Judge Payne, they’re like a team—yet he wants this all to himself and there's a purpose behind it IMO.
