So, now RIAA is going into court tomorrow, suing
the defendants for violating the copyright on stuff that RIAA does not
own (at least as far as this case goes).
The real shame is there are people out there that will get sued and be bullied into a settlement because they don't understand the basic tenets of law, like a plaintiff's standing requirement. Beckerman, the attorney opposing the RIAA, clearly understands that this is their achilles heel and is doing everything under the law to subvert their ill-conceived and ill-supported mass-production lawsuits.
What's worse, and IANAL, is that I believe the RIAA can keep doing this with impunity. The only consequence is a smackdown here and there, and they know it's a small price to pay versus halting their intimidation racket. That makes them scumbags, which we knew all along.
Beckerman is a hero. I hope his name is known more and more so that if any Joe-citizen receives a summons from the RIAA, they know whom to call.
