Oh, something else that should be noted: of the three judges making up the Third Circuit panel that ruled on this appeal, two of them (Chief Judge D. Brooks Smith and Michael Chagares) were nominated to the Third Circuit by George W. Bush, and the third (Stephanos Bibas, the judge who wrote the opinion) was nominated by Donald Trump.
