That does not apply to this case.
How many times must I explain this? When you contract with the government to do, or not do, a particular thing; then it becomes a matter of contract law. The government is not in the role of a governing body, but rather in the role of a party to a contract.
As I have already explained: not long ago, I was working for a defense contractor, on a military base. As a condition of my employment, I had to stand for the anthem. Thousands, if not millions, of civilians are bound by the sorts of agreement between government and government contractors.
Contracting with the federal government to have your employees conduct themselves in a certain manner, is extremely common.
