"Thank you for airing this story. The Provenge situation is particularly troubling. As Dr. Gottlieb mentioned, the FDA ignored its own advisory committee, which had voted 13-4 that the treatment was effective and 17-0 that it was safe, and refused to immediately approve the treatment. While this in itself should raise eyebrows, the background story is even more interesting. The most vocal advisory panel critics were oncologists who were allowed to participate despite major conflicts of interest. I am a Democrat who works in your district who has lost too many loved ones to cancer. In your opening statements at the May 1 committee hearing on the FDA, you correctly noted that, “key decisions at FDA have been made under the cloud of real or perceived political interference, undermining FDA’s most basic foundation.” In your efforts to monitor this, I encourage you to look into the FDA’s May 9, 2007 decision regarding the treatment for prostate cancer, Provenge. The FDA contradicted the vote of the its own scientific advisory panel, which voted 17-0 in favor of Provenge’s safety and 13-4 in favor of Provenge’s efficacy on March 29, a vote that was hailed by 19 prostate cancer advocacy groups.[1] Yet, rather than approve the application, the FDA requested yet more data. Depending on the nature of the data required (which is unclear at this point), this may take the company as long as 3 years to produce, contributing to the early deaths of thousands of Americans with prostate cancer. Your words on May 1 are applicable here, “. . . we know incompetent government can have deadly consequences.” Two Wall Street Journal Articles put it best. In one, former FDA official Mark Thornton addresses the decision on Provenge, saying “The FDA’s hubris will affect the lives and possibly the life spans of cancer patients”[2] Another notes: “The FDA knows that it can make two types of errors. If it approves a drug later found to be dangerous, bad things happen . . . the media pounces, the public denounces and Congress pronounces. If the FDA fails to approve a good drug, few bad things happen -- to the FDA.”[3] Representative Waxman, only you and Congress can correct this balance in the interest of the people. As far as I can tell the FDA overruling their own panel for a treatment that is unanimously agreed to be safe and extends survival is entirely unprecenented. Further post-marketing studies could have been completed to back up efficacy data, so why deny prostate cancer victims this treatment? From the outside it appears that the FDA may have made this decision based on something other than science, but only an investigation can determine this. Questions abound. For example: Since the FDA told Dendreon that their current data was sufficient for a Biologic License Application, and the FDA’s own scientific advisory panel overwhelmingly supported Provenge, why did the FDA suddenly reverse course and decide that the data was insufficient? Prior to the decision, two highly unusual letters written by people with known ties to competitors’ chemotherapy products[4] (Maha Hussain, Howard Scher) were leaked to the press. What influence did these and other outside factors have? A third letter by Thomas Fleming (who also has conflicts of interest) was curiously addressed to Deputy Commissioner Janet Woodcock[5], who is tied to potential politicizing the FDA’s decisions on Plan B. Why was it addressed to her rather than to Commissioner Andrew Von Eschenbach? It is possible that nothing improper has occurred, but I urge you to ask the FDA for clarification and to urge the FDA to move quickly to give patients access to life saving drugs, especially those that pose no safety risks, as is the case with Provenge. Of course personalize it as best as you can (this letter is geared toward Waxman in particular) and correct my embarrassingly bad typo on the word 'unprecedented'. If this particular letter doesn't work for people, I also recommend Barrybonding's now famous letter and there are good ones in Yarbonero's collection (114205-09).
