The article's author is Anders Bylund, who has written negatively about VHC in the past. It's odd he thought it important to include VHC and Gabriel in the article, particularly since the Cisco trial resulted in non-infringement for Cisco:

He could have written the article without mentioning VHC and Gabriel with no loss of relevancy, so it seems like a pointless point to point out.
