Dr. Farmwald
I would just offer this to the Board about Dr. Farmwald's opinion on VHC's patents; how can Dr. Farmwald see so clearly that VHC's patents are invalid because of prior art , yet when Dr. Farmwald was the president and one of the founders of Rambus, he not only couldn't get the patents monetized, his company faced sanctions for allegedly misleading the standards body by issuing patents based on standards Rambus allegedly stole during the technical discussions. This was all brought out in court. There was also a discussion accusing Dr. Farmwald of being less than honest at Rambus's first trial. Dr. Farmwald eventually left Rambus and the company failed miserably in monetizing their patents and Rambus settled with the likes of Micron, Hynix and Samsung for pennies on the dollar. The results of Dr. Farmwald's ability as company founder and company president should cause each of us to wonder why his opinion matters at all when discussing our patents. In my opinion, he is no InvestorDon.
I will take my chances with the founder of VHC. A man who at RSA, licensed over 90% of the software to the world, who had the vision to acquire the patent rights and pull the entire inventor team with him in starting a new company called VHC, who negotiated a contingency deal with McCool Smith ( arguably one of the best legal patent firms in the US) to litigate their patents, who beat Microsoft and signed a license deal with Microsoft, beat Apple in court and is now on the verge of bringing Gabriel and licensing to the company. My coin flip comment remains in play and my bet is on a man who has had very different results so far for his company. I also spent the weekend arguing with one of my friends here in Tucson about the family bonuses. There is a saying "we don't know, what we don't know", in other words, we all might be angry in judging what we see as excessive compensation, but we don't know what promises were made to people at the start of this company. Would anyone here prefer to see family members sell their shares on the open market to get their money that way? I would venture to guess that family members selling their shares would have done much more damage to shareholders than what they feel is excessive compensation. At the ASM, in front of the people who are in charge, I hope we can get some insight into what is really going on at VHC....until then, lets leave our judgments to someone else. "We don't know what we don't know" but in about three weeks we can ask. By the way, my wife noticed that the ASM's date is the day before the standard monthly May options expire. The Gabriel presentation is after the market closes and the day before options expire, giving the shorts just one trading day to respond to any ASM news. Maybe KL has a surprise for the shorts who don't cover prior to the market closing on May 14th. I guess the shorts have a coin flip to make as well. Best Regards, Gare |
