[Excuse me can we strike that and replace with bs?] But c'mon Judge, Apple has lied through their teeth throughout litigation. They lied to the jury about cost and time of any workaround. They lied about disabling VPN on Demand until after this court ruled on an injunction. They lied during USPTO trials about real party of interest on an IPR. In fact, Your Honor, a fair question may be if you've worn your waders on today? You may need them. Plaintiff is so sick and tired of navigating through smoke Your Honor, to expedite this proceeding we're introducing simplified model that even counsel Danny Williams should get it. So let's stop tip-toeing around the ring Your Honor. This trial is not exclusively about VPN on Demand and FaceTime, because that is not the invention. What Plaintiff is presenting is several similar services, all of which provide security. It's important to note, however, that none of these services own patented methods like VirnetX owns their patents. They are also services that are inferior solutions in comparison to the Plaintiff's solutions. Your Honor, we are not here to nit-pick on why VirnetX's patented methods allow for a much more scaleable, flexible or superior user experience. Those things Apple may say are subjective. We're here to prove, Your Honor, that other providers are offering inferior products in comparison to those employed through Apple's FaceTime and VPNoD. These are user experiences that would be considered less desirable applications than the features VirnetX's patents are delivering for Apple. But what is most important, Your Honor, are those inferior solutions are quoted for nearly $10 per month. And damn Your Honor, Amazon just announced its own service for an encrypted email service that is currently priced at $4 month for the privilege of an inbox. Holy crap, Your Honor, VirnetX does a butt load more to enable secure communications, and we're only asking Apple for $4 per device...no questions asked. That is not per month, per year, per nothing - $4 per device and they can integrate all the patented technologies, any application. Bottom line, Your Honor, Apple infringes and others pay a lot more than VHC is asking for comparable security features. |
