Apple lost. They are fighting for the smallest possible payout. The problem is Apple lied to the jury in the first trial and was reported as "grossly misrepresenting" the true cost of the workaround(s). They also went public saying they were going to change the behavior of VPNoD because of a trial loss to VirnetX. Then, after the Judge ruled on an injunction they updated that notice to say they were no longer going to make that change.
They wont have the luxury this time around as VHC got their hands on the real projections after the verdict of the first trial. To make matters worse, Apple is forced to argue that the security component provides very little value to customers and is not important to Apple. But the Tim Cook privacy commitment that was initiated in 2014 is contrary to that argument.
If Apple wasn't a ball busting cash machine, they would be negotiating. I'm not holding my breath. We'll likely see juicy partnerships and the sails catching a good wind before Apple realizes that during the course of busting balls they took a bigger blow to the family jewels than they dished out.
