If it's alright with you, let's have a look at some inaccuracies from the "extremely conservative" White Paper which are just a tiny bit larger than $10m? Please refer to page 87 of the White Paper. I will compare the projected litigation proceeds with the actual: Cisco Projected: $500m gross / $218m net, Actual: $0 NEC Projected: $20m gross / $9m net, Actual: c. $0 Avaya Projected: $60m gross / $24m net, Actual: c. $0 Mitel Projected: $5m gross / $3m net, Actual: c. $0 Siemens Projected: $15m gross / $7m net, Actual: c. $0 Apple Projected: $500m gross, Actual: $368m remanded for further proceedings In total the White Paper is off by a mere $732m, and that's giving VirnetX credit for winning the same award the next time around (highly unlikely in my opinion). But wait there's more: 4G Product Licensing 2013-2014 Projected: $130m gross / $70m net, Actual: $0 SDNI 2014 Projected: $120m gross / $60m net, Actual: $0 I would really spend much more time worrying about the glaring inaccuracies above, especially when the estimates were characterized as "extremely conservative". As for the $10m difference in your and my estimates for the Microsoft proceeds: 1. I have never seen anything to suggest that SAIC has no further right to litigation proceeds. As far as I can tell you're just guessing, which is further suggested by the fact that you went through a lot of trouble to dig up info from 10-Qs but didn't present any evidence to support this assertion. 2. The proportion in which one is able to offset taxes using NOLs is not necessarily 1:1. I am not a tax expert, but I don't believe that VirnetX will be able to defray the entire tax balance. 3. Regardless, $10m is around 3% of the current market cap! I think you're really grasping at straws to characterize that as an "inconvenient fact". Regards, Amadeus |
