Re: Nokia Brief--against apportionmentSo, here is a very simple question/comment. Nokia has filed an amicus brief because, as a patent inventor themselves, they do NOT wish to see this CAFC decision upheld as it will damage their own portfolio of patents, as well as hinder the process of patenting new devices/methodologies in the future. Nokia goes on to say that they are basically agnostic about the specifics of the Virnetx case...But Nokia believes that the CAFC decision was wrong/in error relating to reasonable royalty calculations and reliable methods. So, here is a TECH TITAN that agrees with Virnetx's legal team who is filing for en banc review...And, as others have pointed out, a victory for Apple/defeat for Virnetx should, theoretically, make Apple and other tech titans a bit squeamish as this means they can no longer legally harass infringers who have "stolen" their patents....In short, Apple can no longer sue Samsung until the end of days because, well, CAFC just said that Apple is in the same boat as a plaintiff as Virnetx, the so-called patent troll. So, with all of that said, here is my simple comment. If Nokia feels so strongly about the miscarriage of justice in the Apple/VHC case that they have filed this amicus brief, isn't it logical to ask/wonder whether Nokia might not see tremendous risk/reward upside in VHC common at these LOW LOW prices? Nokia no longer a handset manufacturer, having sold to MSFT...So, they are not in negotiations with Virnetx....Why not place a well-reasoned "bet" on VHC at $5/6 share? Or, if that is not Nokia's "thing", why won't KL and/or Cowen point out this "vote of confidence" from Nokia as a selling point for high-risk investors to buy some VHC at these levels? Just asking |
