Re: Question - what is the likely effect of summer vacations for the judges on the timing of the Opinion ? Anybody know ?
Sadly, judges Prost and Chen were remiss in not alerting Ming for his approval before planning their vacations, However, Ming can say this. There are oral hearings for the United States Court of Appeals for the Federal Circuit in August on the fourth through the eighth of the month. In September oral hearings are scheduled from the eighth through the twelfth.
While the above doesn't directly answer your very good and pertinent questions, nor does it provide solace as to the whereabouts of the two justices assigned our case for review, it does indicate some semblance of business as usual and intimates that at least some justices, after turning up the air conditioning will still be at their posts.
