...shall not release or publicly disclose any PFS data of the Company or any Subsidiary before the sixty-first (61st) day anniversary of the Closing Date.
Now why would an investor that just bought up a pile of warrants not want the PFS data to become public unless they were pretty convinced that it was negative? If the investor thought the PFS data was going to be positive, they would want it released today as it would lift the price, let the investor make a quick buck, and they could exit the deal while laughing all the way to the bank.
The corollary to this should be obvious.
