I know the other board is looking to move on from the ITC....and it wouldn't necessarily surprise me if IDCC did (having seen the ITC pass the buck many times in the Rambus case I wasn't surprised that they would try to kick the can down the road with IDCC) ....but regulars on the Investors Hub board are premature in thinking that IDCC won't decide to appeal the decision.....which isn't even out except in summary form. I realize that Merritt didn't indicate IDCC would appeal in its press release....but without seeing the details of how the Commission justified introducing evidence from the other cases into THIS case...my belief is that he wants the lawyers to parse the decision before deciding to move forward with an appeal or just move on. Rather than promise something immediately....he left the unasked question unanswered....which was the wise thing to do.
I saw that someone put up a $200+M litigation spend figure in the Nokia case....which is probably a full order of magnitude too high...even over a 7 year case. An appeal to the CAFC...if there are grounds...might be worth the $1-$2M just to preserve the "reverse hold-up" part of the ALJs ruling.
