CAFC Oral Arguments todayListened to the recording of the Interdigital vs ITC oral arguments before the CAFC over some of their patents. Appeared to me that it is likely that the CAFC is going to remand to the ITC the decision in part, particularly based on the "short codes cannot carry data" argument the ITC Commission decided. I'm nowhere near as confident that Interdigital will get a remand regarding the power ramp-up patents. My view of the lawyers (from hearing them): Interdigital's : Not smooth, disjointed somewhat. Even so, was very confident regarding his arguments on the first patent...not nearly so on the power ramp-up. After respondent's arguments, he did come back strong and was much more confident in his rebuttal. ZTE's (Asian lawyer): Smooth but was spouting lies in his argument (pretty obvious when Interdigital's lawyer had just presented the passage 4 min earlier which refuted what ZTE's lawyer claims). Other Respondent (not sure who represented): Best speaker of the three but not convincing on the first patent (imo). VG |
