Re: 2 questions"2/what is status on lawsuits" Per the U.S. District Court in Tennessee, the current status on the lawsuits is provided below. On June 5, 2015, Provectus filed its Motion to Dismiss the case. The Plaintiff filed its reply to the Motion to Dismiss on July 20, 2015. Provectus had until August 19, 2015 to file its reply to Plaintiff's reply to dismiss. On July 22, Plaintiff filed a Motion of Request for Oral Argument - see request below. On February 3, 2015, this Court entered an agreed scheduling order (the “Scheduling Order”) submitted for entry by Defendants and Lead Plaintiff Fawazz Hamati (“Lead Plaintiff”), which set deadlines for the filing of (1) an amended consolidated complaint; (2) a motion to dismiss; (3) a response in opposition to the motion to dismiss; and (4) a reply in support of the motion to dismiss (the “Reply”). [Doc. No. 102]. Pursuant to the Scheduling Order, the deadline for Defendants to file the Reply is Wednesday, August 19, 2015.
Defendants respectfully request that this Court extend the deadline for Defendants to file the Reply from August 19, 2015 to September 18, 2015. Undersigned counsel has discussed this motion with lead counsel for Plaintiffs and is authorized to represent that counsel for Lead Plaintiff agrees to the requested relief.
