last post tonight1st off , everybody is welcome. I enjoyed it and will go to the next hearing to figure additional damages... there will be one because even if there was a work around that works, they still had a period of time to execute the change over durnig the stayed injunction and appeals.
mr. e* and others did say they had trouble with the downloads and it didn't happen overnight, so some boxes infringed for a long time. I will note that e* people have said, they have no way of "knowing" or "proving" what boxes got the updated software. they say all did, but can't provide any data.
Robert Hilman (sp?) was the senior attorney at fish. at the beginning his credentials were impressive.MIT undergrad in phsics and economics.... then harvard law. 47yrs of patent practice since getting his license in '62. special master for Judge wilson in Las Vegas in a huge semiconductor trial.... Suppose to be some big mention of him by the CAFC in that case.
Same old story, big name, big firm, but Mr. Chu tore him up.
he Didn't know about HJF theatening sanctions during the trial of E* attornies becasue their witnesses couldn't agree on their opinions of what the other was thinking. some convaluted thing that almost got them in big trouble w/the judge. He claimed he reviewed all of the trial stuff and this was something big he should have known about. everything he was suppose to know about, he couldn't answer. really sad.
After Charle was up, they put on their expert witness to rebut Dr. Storer.
This was terrible. I don't know what he said or if it was right or wrong. I call him uncle story teller. I was expecting him to start telling stories about taking his grand kids fishing.
I had to leave at the break so that's where i left it.
as you can read in the bloomberg article. this is big. the numbers are actually bigger now than the original infringement.
Good luck and place your bets. I think there will be a settlement. Mr E* can't or doen't want to pay for another adverse ruling.
