AN OPEN LETTER TO JUDGE WHYTESir, my license to write this letter is three-fold. 1.My handle of eng94th stands for England and the Bomber Group where I flew 25 missions and earned the Distinguish Flying Cross in WW II. When sir, was the last time you served your country in combat? 2.I have built a national company and have represented major organizations from GE on down. Sir, when was the last time you had to meet a payroll? 3.As for life experiences, my sons were children when my wife died. I raised them past college and into manhood. I know what it is to juggle many of life’s bouncing balls and come up with answers. Do you? So, in my 85th year, I believe I am your senior in age, military service, business and life experiences. Therefore, all this gives me the right to ask simple questions. Bypassing all the legal mumbo jumbo, have you not learned anything from the actions and writings of Judge Ambler, Judge McGuire, Judge Rader, Judge Weinstein and the one-sided verdicts? How infantile is your rantings of “insanely expensive” when these high priced corporate attorneys know the numbers better than you ever will? Then again, the big numbers are in Judge Kramer’s court, not yours. When you did get a responsible number, you cut it to almost a third. Since I do not know you personally, I have tried a thousand times to rationalize your behavior. I keep coming back to the same answer. You strike me as a super bright but frightened old man hiding behind a black robe. You relish the reputation of being the grand patent whiz – but you live in constant fear of being overruled. Hence, the interminable delays and total lack of understanding business realities. Wake-up Whyte - settlement without a favorable Ranbus decision will just not take place. So, let me offer some fatherly advice. “Get off your ass, render an equitable/business decision and have the bond cover the full amount. Then, if you have any balls at all - you would complete this 9-year old case by winter.” Yes, I do own Rambus stock – but how the hell does that alter Ambler, McGuire, Rader, Weinstein and lop-sided verdicts?
