Alberta dismissed? More tricks by Sammy?I was just checking the Alberta docket and came across a couple of interesting items. First, from a filing in October: "After Rambus filed the present motion, Alberta finally consented to produce one additional document concerning its relationship with Samsung (for a total of two documents)-- the membership agreement. (See Pl.’s Opp’n at 6, n.1.) Interestingly, this belated limited production, which Alberta continues to argue is not relevant, (see id. at 6), shows that Alberta’s representations during the parties’ meet and confer discussions were blatantly untrue, and more significantly, that Alberta’s previous signed written response to Rambus’s First Set of Requests for Production was deceptive and misleading. (See Summerfield Decl. Exs. B, D; Moran Decl. Ex. 8 at 3.) The membership agreement Alberta recently produced shows that Samsung Electronics Co., Ltd.-- the very same entity who is a named defendant in the related case filed by Alberta, with whom Alberta claimed it “has had no relationship at all” (Summerfield Decl. Ex. B)-- was or is a member of Alberta. Rambus therefore seeks an order compelling Alberta to immediately produce all other documents concerning its relationship with Samsung pursuant to Rambus’s Request for Production No. 6 propounded back in June. See Fed. R. Civ. P. 37(a)(2)." Second, a *PROPOSED* order dated 12/6/07: Pursuant to Rule 41(a) of the Federal Rules of Civil Procedure, Plaintiff Alberta Telecommunications Research Centre d/b/a TR Labs and Defendant Rambus Inc. hereby stipulate to the dismissal with prejudice of the Amended Complaint. Each party is to bear its own costs and attorneys’ fees. It's not signed though and the case still appears to be "open". |
