Capstone has most definitely developed a C250, under the watchful eye of the DoE who contributed financially to its development. Naturally, the C250 development has informed improvements for the C200 and those improvements have been incorporated into the C200. There is nothing wrong with that, it is completely in the spirit of the DoE's desire to foster energy reform. The decision to shelve the launch of the C250 must have been squared off with the DoE, and the market was informed as that decision was taken. Given the situation Capstone was/is in, the caution is understandable.
I think the policy of preemptively replacing the problem part in early C200s under warranty was Sensible. Shareholders were in fact aware that there was an unforeseen warranty issue with the C200, Capstone did the honorable thing for customers by putting the engines right before they gave trouble.
If you want to get litigious over the C200, we could sue UTC for missing the fault even though they were paid handsomely for development work.
But I'd rather all cantankerous buggers stayed away from lawyers.
