Bin, you are one of the most knowledgeable posters I have seen anywhere, but I think you are getting your wires crossed on this one. If what you are saying is true, this would be an attempt to patent what is already happening in nature. The patent covers using the site normally used by an transcription factor (and other sites as listed) to its own purposes. You can anything (listed) there to do anything you want to regulate the gene. You can bind a CRISPR to cleave the gene. To my eye, you have to use a binding site that isn't listed to get around the patent. (or some un-named thing to bind there). If this is not correct, I would greatly appreciate an explanation.
