Why Have The Utah Judges Been So Biased Against Novell?
All Novell wanted from SCO was $23 million or so from the Microsoft and Sun agreements and all the other sucker^H^H^H^H^H customers who bought Unix IP SCOsource licenses. Did Judge Kimball tell SCO to hand it over to Novell? Not really. He held a trial, and then only granted Novell $2.5 million or so - a trifling sum. So, was Novell able to collect even that small pittance? Not yet. The only one who offered any help was Judge Gross (NOT a Utah Judge), who allowed Novell to rummage through SCO's bank accounts and suck out 600 grand or so. The only way Novell will collect the rest is if SCO wins big against IBM. So, did Judge Nuffer help out Novell? Not a whit. Nuffer's past generosity is long forgotten.
One has to think that Novell would have had a more favaorable outcome had it hired Parr Brown. Perhaps the Judges were annoyed that Novell had moved its corporate HQ out of Utah to MA.
