Re: Google and Cisco settle with Rockstar I'll be interested to see if any [actual] details of the Google settlement terms leak out. Cisco has to protect their customers. Google has always said that vendors who use their products are free to sign agreements if they wish to. It makes me wonder if the settlement terms aren't vastly different since there has never been any mention of shielding Android/AOSP vendors from liability. <baseless_speculation> This makes me wonder if Rockstar didn't find itself in the same position with Google as M$ did against Barnes & Noble; unable to win and consequently compelled to settle in order to prevent a negative legal precedent. Settling could be in Google's interest since it keeps their position of allowing vendors to do what they want. B&N obviously 'won' their settlement. Not only were they the net payee they were able to announce that result as well. This is something no one else was able to accomplish even though a number of industry analysts have said that companies like Samsung are getting $1.2 billion in partner payments while paying $1 billion in purported royalties. A situation that Nokia probably envied since they went with M$ and lost $15 billion. If Google isn't paying and no negative declarations that impact them Android vendors are issued then they maintain their status quo of being free of liability and allowing vendors to make their own deals. The fact that Rockstar isn't claiming that they have a licensing or cross-licensing deal or any positive net cash result seems interesting to me. <(^8)< </baseless_speculation> But I don't really know. Just hoping for a result like that. I haven't seen any coverage of the hearings, so I don't know if things looked like they were favoring Google or Rockstar. I guess I'm mostly just wishing here. Does anyone know of any coverage of the proceedings? |
