Re: En banc I basically see VRNG as a coin flip for en banc. Which is relatively great odds. Coin flips provide great odds only with two-headed coins when you are aware of that fact. When we got a German Shepherd pup from a shelter, I asked a German Shepherd expert how high a fence we needed. Her answer was that it didn't much matter how high the fence was.since German Shepherds were the high jump champions of the dog world, were one of the breeds that could climb fences, were quite adept at tunneling under fences and, if all else failed, were smart enough to find a way our. An owner could only hope the dog liked where it was. You probably don't need to know all that to understand it is likely to be best to put your money on a high jump contest between a German Shepherd and Dachshund but it could help to know if the German Shepherd is in final stages of hip dysplasia and can only crawl. The basic challenge is that you need 6 out of 12 and if you need en banc that means you lost either all 3 judges on your panel or 2 of 3. It's quite unlikely that they will favor en banc if they were against you in their opinion. So having a dissenting judge increases your chances tremendously. Especially if that judge makes a passionate argument in the dissent. IMHO this kind of info from you is worth far more than a truckload of dubious data and frankly so is the unsupported opinion of a knowledgeable expert with long experience in the field. The coin flip analogy is a lousy one on its face considering the odds are relatively easy to fix [not precisely 50/50 but close enough]. I would much rather bet on you.
