binutils source code from SCO - Second Opportunity!

To: The SCO Group

Subject: Missing file - FOUND!!!

Recently we pointed out that you might be in violation of the GPL due to
the fact that you are distributing a binary copy of the "binutils"
package, apparently without providing the matching source code. [In case
you are curious, the binary copy is part of "skunk-7.1.1.iso", available on
your server ftp.iso.caldera.com.] However, we are pleased to report that
we were in error - you are, in fact providing the source code, in full
compliance with the GPL. As you are well aware, it is located at

ftp://ftp.sco.com/pub/openserver5/opensrc/source/gnutools-5.0.7Kj-SRC.tar.bz2

and has been since Aug 4, 2003, 4 months after you filed your lawsuit
against IBM. Further, it contains, not the crufty old version 2.8.1 that
is found on the iso, but rather the more modern version 2.14, which is the
same version identified (by version, file, and line-of-code - Judge
Wells would be proud) by Brent Hatch, April 19, 2004 in Exhibit G, with
respect to which he stated:

"1. SCO, as the copyright owner of the source code and/or documentation
upon which the following files and lnes of code were copied or derived,
has never contributed or authorized these lines of code, or the
documentation related thereto, for use in Linux as specified in part 0, or
any other provisions, of the GPL.

2. SCO, as the copyright owner of source code and/or documentation upon
which the following files and lines of code were copied or derived, has
never granted a license to any party that knowingly authorized use of
these files or lines of code outside a UNIX-based distribution.

3. All of the following files or lines of code, or files and lines similar
thereto, have appeared in major releases of Linux, and have also appeared
in SCO's redistribution of Linux. At the time it redistributed Linux, SCO
was not aware that its intellectual property had been copied or
misappropriated and placed into Linux without SCO's authorization or
consent."

We would also like to note that you are making good use of still more modern
versions of "binutils". On Oct 14, 2005, more that 1 year after Brent
Hatch flagged "binutils" as infringing SCO's rights, your employee Kean
Johnston submitted a large patch to the "gcc" project with the following
documentation regarding how to compile the newest versions of "gcc" on
OpenServer:

"You will need a patched version of a modern GNU binutils (2.16.91.0.3 or
later). Hopefully the required patches for SCO support will be accepted
in time for the next release of binutils."

We apologize for any unwarranted aspersions we may have cast on you and we
applaud your efforts to remain compliant with the GPL. Please, keep up
the good work!

As it looks this afternoon our Japanese  friends have stopped serving
ftp.sco.co.jp/pub/openserver5/opensrc/source/gnutools-5.0.7Kj-SRC.tar.bz2

If we also should lose
ftp.sco.com/pub/openserver5/opensrc/source/gnutools-5.0.7Kj-SRC.tar.bz2

be advised to initiate action to make sure  that "The SCO Group" complies with The GNU Public License.

Now we continue at IV with our usual program.

It would be a shame if gnutools-5.0.7Kj disappears. It contributed greatly to
the "success story" of SCO customer Pete Wilson, who was able to "grow his business"

"In order to install the previous pre-compiled SCO distribution of gcc and
get it to work correctly, I needed
OSS646B - Execution Environment Update
gnutools v5.0.7Kj - this replaces OSS658A, which is no longer
available. It does not install over Skunkware 2000, so I suggest making hard
links from /usr/local/bin to /usr/gnu/bin for all files in /usr/gnu/bin."

He was able to do this just a few weeks before Brent Hatch filed Exhibit G,
revealing that "gnutools v5.0.7Kj" violates SCO Intellectual Property rights.

The GNU Development Tools supplement, provides an update to the suite
of tools from the GNU project that was included in SCO OpenServer Release
5.0.7.

not as part of this supplement. If you wish to see the source code,
please download the original packages from the Internet. The source
code for the collection as it was compiled will be made available on

IV. New in this version

This version contains several improvements over the GNU Development Tools
package included in SCO OpenServer Release 5.0.7. This section briefly
lists the packages updated and improvements made.

o The GNU Compiler Collection was updated to fix several internal bugs
o TCL and Tk 8.4.2, TclX 8.3.5 and expect 5.38 were added
o DejaGNU 1.4.3 was added
o bison was upgraded to version 1.875
o gawk was upgraded to version 3.1.3
o coreutils was upgraded to version 5.0
o autoconf 2.13 and automake 1.4-p6 were added for older programs
o autoconf was upgraded to version 2.57
o automake was upgraded to version 1.7.5
o cpio 2.5 was added
o autogen 5.5.3 was added
o Guile 1.6.4 was added
o grep 2.5.1 was added
o sed was upgraded to version 4.0.7
o jwhois was upgraded to version 3.2.2
o GDB was upgraded to version 5.3
o cvs was upgraded to version 1.11.5
o indent was upgraded to version 2.2.9
o groff was upgraded to version 1.19
